Daily living is filled with dangers and hazards. Slips, trips and falls are a leading cause of injury in the United States, second only to motor vehicle accidents. Over a million people each year will sustain an injury from a fall caused by a slip or a trip.
There are two common types of falls:
- Same-level falls. Same-level falls generally involve a slippery surface, poor lighting, an object in the walking path or a hole or depression in the surface.
- Elevated falls. Elevated falls are less common but can lead to the most severe injuries. Common examples of elevated falls are falling down the stairs or from a ladder.
The back is the most frequently injured part of the body in falls followed by the joints, including the wrist, elbow, shoulder, ankle, knee and hip. Falls are also the leading cause of brain injuries.
Your Rights
In most situations, the injured person and the property owner share varying degrees of responsibility for the fall. Was the property owner aware of a hazardous condition and did he taken the appropriate actions to correct it? Was the hazard open and obvious or was it unavoidable? The merits of every set of facts must be carefully evaluated by an experienced attorney before a determination can be made as to whether a legal action is warranted.
